FotoTrim User Service Agreement

Welcome to FotoTrim (hereinafter referred to as "this App"). Before using the services of this App, please carefully read all terms of this FotoTrim User Service Agreement (hereinafter the "User Agreement"). Your acts of downloading, installing, registering, logging in and using this App shall be deemed as you having fully read, understood and voluntarily agreed to all the contents of this Agreement, and being willing to be legally bound by it.

If you are under 18 years old, please read and agree to this Agreement in the presence of your guardian. You may only use this service upon obtaining your guardian's consent.

We reserve the right to revise the terms of this Agreement at any time in accordance with business iterations and updates to laws and regulations. The revised Agreement will be publicized within the App and shall take effect immediately upon publication. Your continued use of this App shall be deemed as acceptance of the revised terms.

1. Service Description

  1. FotoTrim is a utility application focused on album cleanup, duplicate photo detection, image cropping, photo stitching, and basic image editing, providing mobile-side local image processing and album organization services.
  2. All core image processing and album cleanup features of this App are completed locally on the user's device. There is no mandatory cloud upload, and no behavior of secretly obtaining users' photo data in the background.
  3. We will continuously optimize product features, fix bugs and upgrade services, and reserve the right to add, adjust or remove certain features at any time without prior individual notification to users.
  4. This service is only available for users' personal, non-commercial use, free of charge. Without our written authorization, no organization or individual may misappropriate, reproduce, tamper with, or commercialize the features and code of this App.

2. User Accounts and Usage Rules

  1. This App does not require mandatory registration or login. Users may directly use core features to maximize the protection of user privacy. If value-added services are launched in the future, users may voluntarily choose to log in.
  2. Users undertake that, in the course of using this service, they will comply with national laws, regulations, and platform rules, and will not use this App to engage in illegal, infringing, vulgar, fraudulent, or other non-compliant activities.
  3. Users shall not use this App to batch-process or disseminate infringing images or illegal materials. All legal liabilities arising from users' non-compliant use shall be borne by the users themselves, and we shall bear no joint or several liability.

3. User Rights and Obligations

User Rights

  1. Users have the right to use all basic album cleanup, image editing and stitching features of this App free of charge.
  2. Users have the right to independently grant or revoke the App's album and storage permissions, and to independently choose to clean, delete, or save images.
  3. Users have the right to stop using this App, uninstall the App, and clear local cache data at any time.

User Obligations

  1. Users shall use this service in a lawful and compliant manner, and shall not maliciously attack, crack, or tamper with this App and its data.
  2. Users shall bear all consequences arising from the use of this service, including but not limited to risks such as accidental deletion of images, loss of materials, or operational errors. We only provide tool services and shall not bear any losses caused by users' own operations.

4. Service Interruption and Termination

  1. We shall not be liable for compensation for any temporary interruption or abnormality of services caused by device failures, network anomalies, system upgrades, server maintenance, force majeure, or other reasons.
  2. If a user engages in non-compliant use, malicious destruction of the App, or illegal operations, we have the right to unilaterally terminate the service and ban the user's access.

5. Disclaimer

  1. This App provides services on an "as is" basis, and does not guarantee that its features will be absolutely error-free or uninterrupted, nor make absolute commitments regarding the stability, integrity, or compatibility of the services.
  2. All image cleanup, editing, and stitching operations are independently performed and confirmed by users. We shall bear no responsibility for risks arising from users' own operations, such as accidental deletion of photos, damage to materials, or loss of files.
  3. All image content processed by users through this App shall be the sole responsibility of the users. We do not participate in, review, or store users' original or personal image materials.
  4. We shall not be liable for compensation for functional anomalies or data loss caused by third-party software, system compatibility issues, or mobile device failures.

6. Intellectual Property Protection

  1. All intellectual property rights in the name, trademarks, interface design, code, functional logic, and textual content of this App are exclusively owned by us and are protected by national intellectual property laws.
  2. Without our written authorization, no individual or organization may copy, imitate, tamper with, distribute, or commercialize any content of this App. Violators will be held legally liable in accordance with the law.

7. Agreement Amendment and Dispute Resolution

  1. We reserve the right to update this User Agreement at any time. The updates will be publicized within the App and shall take effect immediately upon publication. Continued use by users shall be deemed as acceptance of the updated terms.
  2. Any dispute arising from this Agreement shall first be settled by both parties through friendly negotiation. If negotiation fails, the dispute shall be submitted to the people's court at the location of our operating entity for litigation.
